Terms of Service

These Terms of Service ("Terms") govern your access to and use of StudyFFective (the "Service"). The Service is operated by Dean Pavlovsky, a sole proprietor based in Ontario, Canada ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of These Terms
By accessing or using StudyFFective, you confirm that you have read and agree to be bound by these Terms and by our Privacy Policy. These Terms form a legal agreement between you and the operator. If you do not accept them, you must not use the Service.
2. Who May Use the Service
You must be at least 13 years old to create an account. If you are under the age of majority in your province or country, you may use the Service only with the involvement and consent of a parent or legal guardian. The Service is intended for personal study use. You may not use it for commercial purposes, resale, or to provide services to third parties without our written permission.
3. Your Account
To use most features you must create an account with an email address and password, or by signing in with Google. You agree to:
- provide accurate, current and complete information;
- keep your login credentials secure and confidential;
- be responsible for all activity that occurs under your account;
- tell us promptly at dean.pavlovsky@gmail.com if you suspect unauthorised use of your account.
You can reset your password by email from the login screen. We are not responsible for losses caused by someone else using your account, except where the loss is caused by our own fault.
4. Acceptable Use
You agree not to:
- upload or submit content that is illegal, infringing, malicious or hateful, or that you do not have the right to use;
- upload other people's personal or confidential information without permission;
- scrape, crawl, copy, resell or redistribute the Service or its output;
- attempt to reverse engineer, disrupt, overload or gain unauthorised access to the Service or its systems;
- use the Service in a way that breaches your school rules or that misrepresents AI output as professional advice;
- use the Service in any way that violates applicable law.
We may remove content or suspend accounts that breach these rules.
5. Subscriptions, Billing and Auto-Renewal
The paid plan (Pro) costs $9 USD per month or $79 USD per year. Payments are processed by Stripe. By starting a subscription you authorise us and Stripe to charge your chosen payment method on a recurring basis.
Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, until you cancel. We may change prices; if we do, we will give reasonable notice in advance and the change will apply from your next renewal. Prices are exclusive of applicable taxes, which may be added based on your location. If a payment fails, we may retry it or suspend paid features until the balance is settled.
6. Cancellation and Refunds
You can cancel or manage your subscription at any time through the Stripe billing portal linked from your dashboard. Cancelling stops future renewals. You keep access to paid features until the end of the period you have already paid for, and you will not be charged again.
Except where required by law, payments are non-refundable. This includes partial periods, unused time, and periods in which you did not use the Service. Deleting your account does not automatically cancel a subscription or trigger a refund, so please cancel through the billing portal first. Nothing in this section limits any non-waivable refund rights you may have under applicable consumer protection law.
7. Your Content
You keep ownership of the files, notes and other material you upload to StudyFFective ("Your Content"). You confirm that you own or have all necessary rights and permissions to upload Your Content, and that doing so does not infringe any third party rights or violate any law.
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and display Your Content, and to create generated study material from it, solely for the purpose of providing the Service to you. This includes sending text extracted from Your Content to our AI provider (DeepSeek) to generate summaries, flashcards, quizzes and chat answers. You can delete Your Content through the app or by contacting us. We do not sell Your Content or use it for advertising.
8. AI-Generated Output
StudyFFective uses artificial intelligence and automated tools to produce summaries, flashcards, practice quizzes and chat answers ("AI Output"). AI Output can be wrong, incomplete, out of date or misleading. It is a study aid only. It is not professional, legal, medical, financial or academic advice, and it must not be relied on as the sole source of truth for exams, assignments or any important decision. Always check AI Output against your original materials and, where relevant, your instructor or another qualified source.
9. Availability and Disclaimer of Warranties
The Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, secure or error-free, or that it will meet your requirements or produce accurate results. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We may modify, suspend or discontinue any part of the Service at any time.
10. Limitation of Liability
To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, grades, scholarships or opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) CAD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing here excludes liability that cannot be excluded by law.
11. Termination
You may stop using the Service at any time and may request deletion of your account by emailing dean.pavlovsky@gmail.com. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive, including content licences for content already processed, disclaimers, liability limits and governing law, will continue to apply.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, take reasonable steps to notify you, for example by email or an in-app notice. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, please stop using the Service.
13. Governing Law and Contact
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-law rules. If you have questions about these Terms, contact Dean Pavlovsky at dean.pavlovsky@gmail.com.
